Perjury suspect Vernon Braun<br />
DEL NORTE — Perjury charges against Vernon Braun will be tried in district court.<br />
The six perjury charges stem from Braun’s 2005 testimony about the Jan. 9, 2002 disappearance of Danice Day.<br />
Vernon is the father of Victor Braun, who was convicted of manslaughter in the death of Day, then 19.<br />
Victor was allowed to plead guilty to manslaughter and to have several theft charges dropped in exchange for the location of Day's remains.<br />
He is serving a 12-year sentence at the Buena Vista Minimal Center.<br />
Under the plea agreement, Victor gave authorities information that not only led to the recovery of Day’s remains, but also led to perjury charges against his father.<br />
In June 2009, seven-and-a-half years after her disappearance, divers recovered Day’s remains from the lake at Lyman Lake State Park, Ariz.<br />
Dr. Leon Kelly, a forensic pathologist from the El Paso County Coroner’s Office, described the remains found in the barrel as “charred small pieces of bones, oil, glass, skeletal muscles, a femur.” He said there was very little soft tissue left, and not enough left of the body to determine how the young woman died.<br />
She was identified by mitochondrial DNA provided by her mother.<br />
Victor Braun told authorities how he took a barrel, cut the top off, put the body in it, then soldered it back together. <br />
He said he then put the barrel in a boat, took it out into a lake, pushed it overboard and waited for it to sink.<br />
The statements upon which prosecutors based perjury charges against Vernon Braun include:<br />
“I was going to Cortez. But if I couldn’t find the car, then I was going to go into Gallup and see a friend over there that had a couple of cars. And he wasn’t home, so then we come back to Navajo and got the boat.”<br />
“Hard to say, probably maybe — maybe a hundred miles, more or less.....maybe we went 40 or 50 miles south of Cortez, and east......to the Navajo.”<br />
Vernon Braun is scheduled to appear before District Judge Martin Gonzales at 1:30 p.m. Monday, Oct. 17.</p>]]>

DEL NORTE — Prosecutors have filed six counts of perjury against a father whose son was convicted in the 2002 death of a Monte Vista woman.<br />
  Vernon Braun, 71, made statements in 2005 under oath that he had not helped dispose the body of Danice Day.<br />
  He also said he had no knowledge of how her body had been disposed.<br />
  Prosecutors allege Braun knew those statements were false along with four others that had to do with his whereabouts, according to his June charging documents.<br />
  Day was 19 when she went missing after her shift at a Monte Vista restaurant.<br />
  Her burned and mutilated remains were found in June 2009 in a barrel at the bottom of Lyman Lake, roughly 170 miles northeast of Phoenix.<br />
  Victor Braun, who had fathered a child with Day, was sentenced to 12 years in prison in December 2009 for reckless manslaughter in connection with her death.<br />
  Vernon Braun is due back in court Oct. 4.</p>]]>

<p>DEL NORTE — On Thursday, Judge Martin Gonzales sentenced Victor Braun to 12 years in the Colorado Department of Corrections for the death of Danice Day.</p>

<p>“Nothing I do here will bring her back,” Gonzales told the family, as he sentenced Braun to the DOC, gave him a $1,000 fine and two years mandatory parole. Gonzales also ordered over $7,000 in restitution in the two burglary cases that were dropped as part of his plea bargain. “But if I sentenced him to anything other than what I am going to sentence him I don’t believe I would be sending the proper message.”</p>

<p>DEL NORTE - The man who pleaded guilty in connection to the 2002 death of Danice Day was given a 12-year prison sentence Thursday.</p>

<p>District Court Judge Martin Gonzales gave Victor Braun, 33, the maximum sentence allowable for reckless manslaughter and pointed to Braun's long criminal history and the seven-and-a-half years of anguish he caused Day's family by not coming forward sooner.</p>

<p>"It's 2,851 days her children did not have her," Gonzales said. "Each day, each hour, each second of that time - her family has suffered for."</p>

<p>DEL NORTE — The same day Danice Day’s family decided to bring closure to her death with an obituary, the man responsible for her death pleaded guilty to manslaughter.</p>

<p>Victor Anthony Braun, 33, Day’s boyfriend and father to one of her two children, pleaded guilty to manslaughter in front of District Judge Martin Gonzales on Tuesday, the day his victim’s family submitted an obituary “attempting to establish closure since the discovery of her body in June of 2009.”</p>

<p>The family of Danice Leah Day, who disappeared at the age of 19 in January of 2002, is now attempting to establish closure since the discovery of her body in June of 2009. <br />
Danice was born May 8th, 1982 in Laramie, Wyoming to Rod and Jonene Day of Medicine Bow, Wyoming. She spent her early childhood in Medicine Bow, Laramie, Wyoming and Del Norte and Monte Vista, Colorado. <br />
Danice went to elementary school in Medicine Bow, and moved to Colorado. She then attended Junior High and part of High School in Laramie. Danice had a close knit group of friends in both Colorado and Wyoming. <br />
Danice will be remembered by family and friends for her bright, beautiful, positive spirit. She will also be remembered as a loving, caring mother to two small children, Joshua and Kaylee. Her children became the light of her life. <br />
Danice is survived by her two children, Joshua and Kaylee; Father, Rod Day of  Monte Vista, Colorado; Mother, Jonene Day of Laramie, Wyoming; Sisters, Julie Flint of Laramie, Wyoming and Jacqui Flint of New York, New York; Grandmother, Bobbie Bourret of Laramie, Wyoming; and numerous aunts, uncles, cousins in Wyoming and Texas. She is preceded in death by Grandfather, Larry Bourret of Laramie, Wyoming and Grandmother, Opal Day of Fort Worth, Texas. <br />
Memorial Services will be held on November 6th in Monte Vista, Colorado and November 13th in Laramie, Wyoming. A Memorial Fund has been established at UniWyo Federal Credit in Laramie, Wyoming, c/o Leslie Johnson.         <![CDATA[<p>We do not yet have confirmation that the remains found in Lyman Lake were Danice. I think, we all hoped for a quicker turnaround, but I suppose these things take time. We are waiting patiently as we have for seven years. We know that we are closer to an answer.  <br />
Thanks to everyone for their outpouring of support in the last month. The response from people who knew Danice at some point in her life or just feel some connection to this case has been greatly appreciated and everyone's comments and prayers mean a lot to my family and me. We get closer to answers every day. <br />
Although there may be closure to this part of the case, as in, we might be closer to long awaited answers, my heart still feels a very open wound. I am still missing Danice and having a hard time believing she is gone. It is cliche, but time is supposed to heal wounds. I am not ready to accept that yet. The fact that she is unable to see her children grow is something I am not ready to accept either. Somehow it seems very unfair, but I will continue to take time each day to just be quiet, sometimes pray, and sometimes just remember a special memory of her. </p>

DEL NORTE — Rio Grande County Sheriff Brian Norton said on Thursday he has still not received confirmation from the El Paso County forensic pathologist that remains found last month in Arizona were conclusively those of missing Monte Vista woman Danice Day.</p>

<p>Four weeks ago today authorities announced they believed they had recovered Day’s remains in Lyman Lake State Park, Arizona. Day, who would have been 27 this year, disappeared on January 9, 2002, from Monte Vista where she lived.</p>

<p>One June 26 Sheriff Norton announced that what authorities believed to be the remains of the missing Monte Vista mother of two were located through a combined effort of the Rio Grande Sheriff’s Office, Apache County Sheriff’s Office and the Utah Department of Public Safety Dive Team.</p>

<p>The remains were turned over to the El Paso County forensic pathologist for further DNA testing that could lead to positive identification. </p>

<p>Sheriff Norton said on Thursday he still has not received word back from El Paso County. When the remains were turned over to the pathologist, Norton said although he hoped for a quick turn around, it could be weeks before he received an answer.</p>

<p>No one has yet been arrested in connection with Day’s probable homicide.</p>]]>

Remains in Arizona May be Day<br />
The disappearance of Danice Day is one of the Valley's most notorious cold cases.<br />

<p>MONTE VISTA — One of the San Luis Valley’s most tragic mysteries may have been solved this week with the discovery of human remains believed to be Danice Day who disappeared from Monte Vista seven and a half years ago.</p>

<p>Day, who would have been 27 years old on May 8, disappeared on January 9, 2002, from Monte Vista where she lived.</p>

<p>Rio Grande Sheriff Brian Norton announced on Friday that human remains located in Lyman Lake State Park, Arizona, are believed to be those of the missing mother of two. Although not releasing the connection between Arizona and the San Luis Valley, or how authorities were led there, the sheriff said the remains were located through a combined effort of the Rio Grande Sheriff’s Office, Apache County Sheriff’s Office and the Utah Department of Public Safety Dive Team. </p>

<p>Norton said the dramatic turn in this seven-year-old case was the result of continued investigation over the years by his office and the district attorney’s office. </p>

<p>Norton said the remains have been turned over to the El Paso County forensic pathologist for further DNA testing that will hopefully lead to positive identification. </p>

<p>“We are looking for a quick turn around,” Norton said. However, he said it could be days or weeks before the results of the DNA testing are available.</p>

<p>The sheriff said he could not comment further on the case until the results are back.</p>

<p>Norton said no one has yet been charged in the Day case, and investigation continues regarding possible suspects.</p>

<p>“Due to court orders, no further information will be released,” Norton stated.</p>

<p>The sheriff said his office notified Day’s family about this most recent development. </p>

<p>The family is “just trying to process it all right now,” Danice’s older sister Jacqui Flint said on Friday. </p>

<p>“Everybody processes grief a little bit differently. Now we just have to come to terms all over again.” </p>

<p>She added, “I thought we would be relieved, and it’s like she is dead all over again because we did not ever know she was fully gone ... We just have mixed emotions ... I am not sure how to feel right now.”</p>

<p>Jacqui said although family members presumed Danice was dead, “we still half hoped ...”</p>

<p>She said from the information provided by the sheriff’s office, the family is fairly certain Danice has finally be found and can now be put to rest.</p>

<p>“We have had so many false leads,” Jacqui said. “We are pretty sure this time. We continually prayed that there would be closure, and this has led us closer to that closure we have wanted for so long.”</p>

<p>Because Danice had not been found, her family had not been able to hold a funeral or memorial for her, or to completely grieve. If the results of the DNA tests come back positive, the family will probably plan a funeral service for Danice, her sister said.</p>

<p>“We will wait until it’s confirmed. I know I want to put something together to make sure she’s honored somehow.”</p>

<p>Not allowing Danice’s memory to fade, Jacqui has maintained a web site “Danice Day, a web site regarding the disappearance of a young Colorado mother of two missing since January 9, 2002.” </p>

<p>The site chronicles the investigations of Danice’s case through newspaper articles from 2002 through last October when a “mystery bone” was found in Monte Vista. The discovery led to another false lead and another false hope for the family.</p>

<p>Initial articles talked about rewards offered for information on “missing mom” and described Danice’s height, weight, hair color, eye color and piercings. </p>

<p>Another article talked about searchers looking for “missing waitress” who already feared she was dead. Further articles spoke about potential suspects. </p>

<p>Letters to the editor were posted from family members. Articles featured candlelight vigils and gatherings on the anniversaries of Danice’s disappearance. First it was one year. This January it was seven.</p>

<p>Many postings were made by Danice’s father Rod who lives in the Valley. He counted the days since his daughter went missing and shared his anger that no one had been held accountable for her loss. </p>

<p>In October 2004, Rod Day recalled in “Danice of a Thousand Days” that it had been 1,000 days at that time since Danice was gone. “It goes without saying---our little girl is still missed very much! And we (all) love her,” he wrote.</p>

<p>Jacqui posted articles about fundraising efforts for the Carole Sund/Carrington Memorial Reward Foundation that posted a reward for information to help find Day.</p>

<p>The Danice Day web site also shared photographs from Danice’s life from childhood to adulthood, remembered special milestones such as birthdays and related the emotions of a family whose loved one was still out there. </p>

<p>An early photo showed a young Danice in a blue sweater, another camping, another with her cousins, and another with her own two children. </p>

<p>Danice’s oldest child, who was only 2 1/2 when his mother went missing, lives with his father in Missouri, and her daughter, who was just an infant when her mother disappeared, is being cared for by a paternal grandfather. </p>

<p>Danice shared a May 8 birthday with her daughter. Danice would have been 27 last month. Her older sister wrote a “happy birthday” note on the web site stating that Danice had been gone so long it felt sometimes as if she did not really know her anymore. </p>

<p>“I do remember this, though, she is/was one of the best friends I ever had and one of the most special people anyone could ever know. The mark she left on her family and friend’s lives will not change or go away.”</p>

<p>Jacqui said on Friday that although the recent discovery of what authorities believe to be her sister’s remains will bring some closure for the family, it will never completely end until someone is held accountable for Danice’s death.</p>

<p>“I just want to see justice,” Jacqui said.</p>

<p>She said one of the people who kept attention on her sister’s case was her grandfather who did not live to see the latest development in the case. He died last September. </p>

<p>“He never gave up. He always said ‘Jacqui don’t ever give up. Something’s going to happen’ ... He was right to keep hope alive.”</p>]]>
